Transparent pricing. Clear taxation.
ChairWellness is committed to providing clear information about sales tax, use tax, applicable local taxes, tax exemptions, delivery charges and the tax treatment of purchases made through the ChairWellness website.
Sales Tax Overview
Sales tax is determined by the applicable tax rules for each transaction, including the delivery location, the taxable status of the massage chair or other product, applicable delivery or freight charges, and any valid tax exemption.
Florida State Tax
Florida's general state sales tax rate is 6% on taxable retail sales, subject to applicable exemptions and exceptions.
County Surtax
An applicable Florida county discretionary sales surtax may apply depending on the transaction and delivery location.
Checkout Transparency
Applicable tax and the total amount due are shown during checkout before the customer completes payment.
General Sales Tax Information
ChairWellness sells massage chairs and related wellness products through its online store. ChairWellness collects and remits applicable sales and use taxes when required by the laws governing the transaction.
Tax may apply to purchases of massage chairs, accessories, equipment and other taxable tangible personal property. The actual tax treatment depends on the product, transaction and applicable jurisdiction.
ChairWellness does not apply one universal tax rate to every order. The applicable tax is determined using the transaction information and tax rules applicable to the order.
Florida Sales Tax
Florida's general state sales tax rate is 6% on taxable retail sales of tangible personal property, subject to applicable exceptions and exemptions.
Florida counties may also impose a discretionary sales surtax. When applicable, the surtax is collected in addition to the state sales tax according to Florida's sales and use tax rules.
County surtax rates are not uniform throughout Florida. Accordingly, the total tax charged on two Florida orders may differ because the applicable delivery locations are in different counties.
ChairWellness will collect applicable Florida state sales tax and discretionary sales surtax when ChairWellness is required to do so by Florida law.
Florida Delivery Location
For taxable Florida transactions, the delivery location may affect the applicable discretionary sales surtax.
ChairWellness uses the applicable delivery information provided during checkout to determine the jurisdiction used for tax calculation, subject to the applicable Florida sourcing rules.
Customers are responsible for providing complete and accurate billing and delivery information. An incorrect or incomplete address may affect the applicable tax calculation and order fulfillment.
Sales Tax in Other States
ChairWellness may be required to collect sales or use tax on taxable purchases delivered to customers outside Florida.
Tax collection obligations may arise under applicable state law, including rules concerning physical presence, economic nexus, marketplace transactions, remote sales and other applicable requirements.
Where ChairWellness is required to collect a tax, the applicable amount will be calculated and collected during checkout.
Where ChairWellness is not required to collect a particular tax, the customer may nevertheless have an obligation to pay applicable use tax or another tax directly to the relevant taxing authority.
Online and Remote Sales
ChairWellness operates an online retail store and may make taxable remote sales to customers in multiple states.
Under Florida's remote-sales rules, an out-of-state retailer with no physical presence in Florida is generally required to register, collect, report and remit Florida sales tax and applicable discretionary sales surtax when its taxable remote sales delivered into Florida exceed the applicable statutory threshold.
Florida currently provides a $100,000 prior-calendar-year threshold for certain out-of-state retailers without physical presence in Florida.
The threshold described above does not determine ChairWellness's tax obligations by itself. Physical presence, marketplace activity and other facts may affect whether and when ChairWellness is required to register and collect Florida tax.
ChairWellness will monitor its applicable tax collection obligations and will collect and remit taxes when required by applicable law.
Taxable Massage Chairs and Products
Massage chairs and related tangible personal property sold by ChairWellness may be subject to sales or use tax depending on the applicable jurisdiction and transaction.
Tax treatment may also depend on whether a particular product, service, accessory or transaction qualifies for an exemption under applicable law.
ChairWellness does not represent that every product or transaction will be taxed in the same manner in every jurisdiction.
Shipping, Freight and Delivery Charges
ChairWellness currently advertises a standard $724.99 delivery or freight charge for eligible U.S. massage-chair orders, subject to the applicable product, destination and shipping terms.
The $724.99 amount is a delivery or freight charge and is not itself a statement that the charge is taxable or exempt in every jurisdiction.
For Florida transactions, the tax treatment of delivery, transportation, freight or shipping charges depends on the applicable Florida rules and how the charge is structured, stated and imposed.
In general, Florida rules can distinguish between separately stated transportation charges that the purchaser can avoid and transportation charges that the purchaser cannot avoid. Charges that are combined with taxable services or otherwise included in the taxable selling price may receive different treatment.
ChairWellness will apply the applicable tax treatment to delivery and freight charges based on the governing rules for the transaction.
Customers should rely on the tax amount displayed at checkout for their specific order rather than assuming that a delivery charge is always taxable or always exempt.
Tax-Exempt Purchases
Certain purchases may qualify for sales-tax exemption under applicable law.
A customer requesting tax-exempt treatment must satisfy the requirements established by the applicable taxing jurisdiction.
ChairWellness may request a valid exemption certificate, resale certificate or other documentation reasonably necessary to verify the claimed exemption.
An exemption certificate does not automatically make a transaction tax-exempt. The exemption must be valid and applicable to both the purchaser and the transaction under the governing law.
Resale and Business Purchases
Businesses purchasing massage chairs or related products for qualifying resale may be eligible for a resale exemption when the requirements of the applicable jurisdiction are satisfied.
ChairWellness may require appropriate documentation before applying a resale or other business-related exemption.
Customers are responsible for ensuring that any exemption claimed is valid for the intended use of the purchased products.
In Florida, resale transactions must satisfy the applicable statutory and administrative requirements. ChairWellness may retain appropriate exemption documentation as required by law.
Checkout Tax Display
Before completing a purchase, customers should be able to review the applicable components of the order, including, where applicable:
- Massage-chair or product price.
- Applicable shipping, freight or delivery charge.
- Applicable state sales tax.
- Applicable local or county tax.
- Applicable discounts or credits.
- Total amount due.
ChairWellness will not intentionally conceal applicable taxes or mandatory charges from customers before payment is completed.
Tax on Customer Invoices
Where required by applicable law, sales tax will be separately identified on the customer's invoice, receipt, sales slip or other applicable transaction documentation.
For Florida taxable sales, Florida law generally requires the tax to be separately stated as Florida tax on the applicable charge ticket, sales slip, invoice or other tangible evidence of sale, subject to applicable exceptions.
The applicable tax amount may be shown separately from the product price and other transaction charges.
Customers should retain invoices and order records for their own accounting and tax purposes.
Customer Billing and Delivery Information
Customers are responsible for providing accurate billing, shipping and delivery information when placing an order.
Tax calculations may depend on the delivery address and other transaction information provided during checkout.
If information is incomplete or inaccurate, ChairWellness may need to correct the transaction information before fulfillment or update the applicable tax calculation when permitted or required by law.
Tax Corrections and Adjustments
If an applicable tax rate, delivery location, exemption, product classification or other transaction detail is determined to have been entered or calculated incorrectly, ChairWellness may correct the tax calculation in accordance with applicable law.
If a correction affects an amount already paid by the customer, ChairWellness will process any applicable adjustment, credit or refund in accordance with applicable tax requirements and the payment method used.
ChairWellness will not intentionally impose undisclosed charges after payment has been completed. Any required correction will be communicated and handled in accordance with applicable law and the terms governing the order.
Refunds, Returns and Sales Tax
If an order is cancelled, returned or otherwise refunded, the treatment of sales tax will be determined according to the applicable tax rules and the nature of the refund.
Where applicable law requires previously collected sales tax to be refunded or otherwise adjusted, ChairWellness will process the applicable tax adjustment.
The treatment of shipping, freight, delivery charges and associated tax may depend on the reason for the refund, the transaction structure and applicable law.
Refunds remain subject to the ChairWellness Returns & Refunds Policy and any rights that cannot lawfully be waived.
Tax Invoices and Documentation
Customers may contact ChairWellness regarding invoices, receipts, order records or other tax-related documentation associated with their purchase.
ChairWellness's transaction records may include product charges, shipping or freight charges, applicable taxes, discounts, payments and other information associated with the order.
Customers should retain their purchase documentation where required for business, accounting or tax purposes.
Use Tax
Use tax may apply when taxable tangible personal property is purchased without sales tax being collected and the property is used, consumed or otherwise subject to tax in a jurisdiction imposing use tax.
In Florida, use tax generally applies to taxable items purchased outside Florida, including certain Internet or remote purchases, when the applicable Florida sales tax was not paid.
If ChairWellness is not required to collect a particular tax on an order, the customer may still have an independent obligation to report and pay applicable use tax or another tax directly to the relevant taxing authority.
Changes in Tax Laws and Rates
Sales and use tax laws, tax rates, exemptions, thresholds and administrative requirements may change over time.
Florida county discretionary sales surtax rates may also vary by county and may change over time.
ChairWellness may update its tax collection, calculation and reporting processes when necessary to comply with applicable law.
The tax charged on a particular order will be determined using the tax rules applicable to that transaction at the relevant time.
